1. The Service

The App lets you keep golf scores, track statistics and round history, and find golf course information. The App is provided free of charge and is supported by sponsorship, as described in our Privacy Policy.

3. Your Content

3.1 Ownership and license.

You retain ownership of the content you create or share in the App — scores, scorecards, rounds, notes, display names, and profile photos ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and process Your Content solely to operate, improve, and promote the App's features, including displaying shared scorecards, leaderboards, and group-play results to the users you share them with. This license ends when you delete Your Content or your account, except for content you shared with others that they have retained, and residual backup copies retained per our Privacy Policy.

3.2 Community features and visibility.

The App includes features that make Your Content visible to other users, such as shared scorecards, group play, leaderboards, and profile photos. You control what you share; content you post to a group or leaderboard will be visible to the other participants or to friends with whom you choose to share. Do not share anything you are not comfortable making visible to others, and do not post personal information about another person — including their name or scores — without their permission.

3.4 Reporting and blocking.

Every piece of user-shared content in the App can be reported using the "Report comment" option next to it. We review reports promptly — ordinarily within 24 hours — and will remove content that violates these rules and take action against the responsible account, up to and including permanent termination. You can block another golfer using the "Block user" option in the same menu, and you can see and undo your blocks at any time under Blocked golfers in your profile. Once you block someone, their comments and reactions no longer appear for you anywhere in the App. Because a scorecard is a shared record of a round you played together, a blocked golfer's name and scores remain on rounds you both played. You can also report content or conduct by emailing support@golfwithscorecard.com.

3.5 Moderation and enforcement.

We may (but are not obligated to) monitor, screen, remove, or restrict Your Content at any time, with or without notice, if we reasonably believe it violates these Terms or creates risk for us or other users. We may suspend or terminate accounts for violations, with the severity of action reflecting the severity or repetition of the violation. We are not responsible for content posted by users, and views expressed in user content are not ours. If you believe content was removed in error, contact us at support@golfwithscorecard.com and we will review the decision.

3.6 Copyright complaints.

If you believe content in the App infringes your copyright, send a notice to support@golfwithscorecard.com including the information required by 17 U.S.C. §512(c)(3) (or, in Canada, a notice under the Copyright Act's notice-and-notice regime). We respond to valid notices, including by removing content and terminating repeat infringers.

4. Acceptable Use

You agree not to: misuse, reverse engineer, or disrupt the App; access it by automated means; upload unlawful, infringing, or abusive content; impersonate others; attempt to manipulate sponsorship placements; or use the App in violation of any applicable law.

5. Golf Course Data & Accuracy Disclaimer

Course information (names, pars, yardages, ratings) is provided for convenience and may be inaccurate, incomplete, or out of date. Any handicap or statistic computed by the App is an unofficial estimate and is not a Handicap Index® or any other official rating under the World Handicap System. Do not rely on the App for tournament or wagering purposes. User-submitted course data is unverified.

Course data displayed in the App is sourced from (a) a third-party golf-course data API, which provides publicly available information such as course name, location, tees, yardages, par, handicap, and slope; and (b) entries we compile ourselves when a course (including a private or members-only course) isn't yet available through the API. For entries we compile, we record only factual details (par, yardage, hole number, handicap, slope) using our own scorecard template. We do not reproduce a course's scorecard, artwork, hole maps, or logo, whether from a website, printed materials, or a user-submitted photo — such materials are used only to extract the underlying facts. Users who submit course information represent that it's accurate and doesn't violate any third party's rights.

Including a course, private or members-only, does not imply affiliation, endorsement, or authorization by that course. Course names, logos, and trademarks remain their owners' property (see Section 7).

The App does not currently include course or hole imagery, hazard maps, or aerial views.

6. Location Features

Location-based features (such as course detection and distances) use a one-time reading of your device's GPS location each time you use them. This location data is processed on your device and is not transmitted to or stored by us (see our Privacy Policy). These features are approximate and depend on your device's GPS accuracy. Always exercise your own judgment on the course; do not use the App while operating a golf cart in motion or where distraction creates risk.

7. Intellectual Property

The App, including its software, design, logos, and non-user content, is owned by us or our licensors and protected by law. These Terms grant you a limited, personal, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. Third-party trademarks (including golf course names) belong to their owners; their appearance in the App does not imply affiliation or endorsement.

You agree to indemnify and hold us harmless from claims arising out of Your Content, your use of the App, or your violation of these Terms or applicable law.

11. Dispute Resolution

11.1 Illinois law governs these Terms and any dispute about the App.

11.2 Before any formal proceeding, contact us at support@golfwithscorecard.com and we'll try to work it out within 60 days.

11.3 Any dispute we can't resolve will be decided by confidential and binding arbitration before a single arbitrator under the American Arbitration Association's Consumer Arbitration Rules. Arbitration will be by documents, phone, or video unless an in-person hearing is required, in which case it will be held in your home county (or another mutually agreed location). Scorecard will pay the arbitration fees beyond the amount of your local small-claims court filing fee, unless the arbitrator finds your claim frivolous.

11.4 Disputes may not be brought or arbitrated as a class, consolidated, coordinated, or representative action, and both of us waive the right to a jury trial. Arbitrations are confidential, except where the law requires disclosure or you are reporting to a government agency.

11.5 Opt-out. You may opt out of arbitration by emailing support@golfwithscorecard.com within 30 days of accepting these Terms. Non-arbitrated disputes belong exclusively in the courts of Cook County, Illinois.

12. Apple App Store Terms

These Terms are between you and us, not with Apple Inc. ("Apple"). Apple has no obligation to furnish maintenance or support for the App and is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or IP infringement claims. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple's sole warranty obligation will be to refund the purchase price (if any) to you. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

13. Changes; Termination

We may update these Terms; material changes will be announced in the App or by email, and continued use after the effective date constitutes acceptance. We may modify or discontinue the App (or any feature) at any time. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, disputes) survive. Material changes to Section 12 will not apply to disputes of which either party had notice before the change took effect.
